U.S. retailer sued by British retailer for product design infringement

Burberry claims J.C. Penney is using its check design illegally.

J.C. Penney Co. is being sued for illegal use of a plaid design by the Burberry Group Plc. In a New York federal court.

The lawsuit alleges the U.S. retailer is using the U.K. retailer's signature design on various clothing, from scarves to jackets, according to a Dallas News report.

The British goods maker, based in London, claims J.C. Penney is selling goods featuring its check design and is seeking to block sales of the goods and wants $2 million for each trademark infringement.

Neither retailer is commenting on the lawsuit, according to the report.
